1. Acceptance of Terms
By accessing and using Alayak (අලයක්), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our service. Yes, even for potato delivery, we need terms.
2. Service Description
Alayak provides a novelty gift service where we write custom messages on real potatoes and mail them to recipients within Sri Lanka. This is a real service with real potatoes. No, we're not kidding.
3. Orders and Payment
All orders are subject to acceptance and availability. Prices are listed in Sri Lankan Rupees (LKR). Payment is processed securely through our payment gateway. We reserve the right to refuse any order for any reason, including but not limited to orders containing inappropriate content.
4. Send As a Gift Feature
When you choose "Send As a Gift", your name will not be displayed on the potato message - the recipient will only see the message. However, your billing information (name, email, phone) is still collected and stored for: (a) payment processing, (b) order confirmation and communication, (c) legal compliance and fraud prevention. We may provide this information to law enforcement if required by law or if the message content is found to be threatening or illegal.
5. Delivery
We aim to deliver within 3-5 business days within Sri Lanka. Delivery times may vary based on location and postal service conditions. We are not responsible for delays caused by the postal service, weather, or acts of nature.
6. Product Condition
We use fresh, quality potatoes for all orders. However, potatoes are natural products and may have minor imperfections. The recipient should receive their potato in good condition, but we cannot guarantee how long the potato will remain fresh after delivery.
7. Content Guidelines & Order Rejection
Messages must be fun, friendly, and harmless. The following content is strictly prohibited and will result in order rejection with full refund: (a) Threats, harassment, or intimidation, (b) Hate speech or discrimination based on race, religion, gender, or any protected characteristic, (c) Obscene, vulgar, or sexually explicit content, (d) Personal information of third parties without consent, (e) Content promoting illegal activities, (f) Any content that violates applicable Sri Lankan or international laws. We review all messages before fulfillment and reserve the right to reject any order at our sole discretion.
8. Order Rejection & Refunds
If we reject your order due to inappropriate content: (a) You will receive an email notification explaining the reason, (b) A full refund will be processed within 5-7 business days, (c) Repeated violations may result in account restrictions. For other refund requests: Due to the perishable and personalized nature of our product, we generally do not offer refunds. However, if your potato arrives damaged or the message is incorrect due to our error, please contact us within 48 hours of delivery.
9. Privacy & Data Retention
We collect and process personal information necessary to fulfill orders. Recipient addresses are used solely for delivery purposes. Sender information is retained for: order communication, legal compliance, and dispute resolution. We do not sell or share personal information with third parties except as necessary for order fulfillment or as required by law.
10. Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of Alayak and is protected by copyright laws. You may not reproduce, distribute, or create derivative works without our express permission.
11. Limitation of Liability
Alayak is not liable for any indirect, incidental, or consequential damages arising from the use of our service. Our maximum liability is limited to the amount paid for the specific order in question. We are not responsible for how recipients react to receiving a potato message.
12. Changes to Terms
We may update these terms from time to time. Continued use of our service after changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.
